Welcome to Outfits AI. These Terms of Service ("Terms") govern your use of the Outfits AI mobile application, website, and services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By downloading the app from the Apple App Store, creating an account, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 13 years old to use this Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Description of Service

Outfits AI is a mobile application that uses artificial intelligence to analyze outfit photos and provide fashion insights. Our Service includes:

• AI-powered analysis of clothing items in photos
• Brand recognition and identification
• Price estimation and outfit valuation
• Fashion insights and style recommendations
• Analysis history and personal style tracking

3. Account Registration and Security

To use certain features of the Service, you may need to create an account using your device identifier. You are responsible for:

• Ensuring your device is secure and protected
• Maintaining the security of your app data and analysis history
• All activities that occur through your device and account
• Notifying us immediately of any unauthorized use of your account
• Not sharing your account access with others

We reserve the right to disable any account if we believe you have violated these Terms.

4. Subscription and Payments

Outfits AI offers subscription plans that provide access to premium features through Apple's In-App Purchase system. By subscribing to a paid plan:

• You agree to pay all fees associated with your selected subscription plan
• Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
• You can cancel your subscription at any time through iOS Settings > Apple ID > Subscriptions
• Cancellations take effect at the end of the current billing period
• Refunds are handled by Apple according to their policies and applicable law
• Prices may vary by region and are shown in your local currency

5. User Content and License

When you upload outfit photos or other content ("User Content") to the Service:

5.1 Your Rights

• You retain all ownership rights to your User Content
• Your photos are processed in real-time and not stored permanently on our servers
• You can delete your analysis history at any time

5.2 Limited License to Us

• You grant us a limited, non-exclusive, temporary license to process your User Content solely for providing outfit analysis services
• This license terminates immediately after processing is complete
• We may use anonymized, aggregated data to improve our AI models

5.3 Your Responsibilities

• You represent and warrant that you own or have necessary rights to your User Content
• Your User Content does not violate any third-party rights
• You have permission to photograph and analyze any clothing or outfits in your images
• Your User Content complies with all applicable laws and these Terms

6. AI Analysis and Results

Our AI-powered outfit analysis provides fashion insights and estimates. Important disclaimers:

• Not Professional Advice: Results should not be considered professional fashion, financial, or shopping advice
• Price Estimates: Price estimates are approximate and may not reflect actual market prices, sale prices, or current availability
• Brand Recognition: Brand identification is based on visual analysis and may not be 100% accurate
• No Guarantees: We do not guarantee the accuracy, completeness, or reliability of any analysis results

6.2 Your Use of Results

• You may use analysis results for personal, non-commercial purposes
• You may not use results for commercial fashion analysis or resale
• We retain ownership of our AI technology, models, and algorithms
• You may not attempt to reverse engineer or copy our AI systems

7. Prohibited Uses

You agree not to use the Service to:

7.1 Content Restrictions

• Upload inappropriate, offensive, or explicit content
• Analyze clothing or outfits without proper authorization from the owner
• Upload content that infringes intellectual property rights
• Share or distribute content that is illegal, harmful, or objectionable
• Upload content containing personal information of others without consent

7.2 Technical Restrictions

• Interfere with or disrupt the Service or our servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems or bots to access the Service
• Reverse engineer, copy, or create derivative works of our technology
• Use the Service in any way that violates applicable laws

7.3 Commercial Restrictions

• Use the Service for commercial fashion analysis without written permission
• Resell, redistribute, or commercially exploit analysis results
• Impersonate any person or entity
• Create multiple accounts to circumvent usage limits

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key privacy points:

• Photos are processed in real-time and not stored permanently
• We use Google Gemini AI for analysis with appropriate privacy protections
• You control your data and can delete it at any time
• We comply with applicable privacy laws including GDPR and CCPA

9. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Outfits AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes:

• Our AI models and algorithms
• App design and user interface
• Brand recognition technology
• Analysis methodologies and processes
• Trademarks and service marks

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material from our Service without our prior written consent.

10. Apple App Store Terms

Since our app is distributed through the Apple App Store, the following additional terms apply:

• You acknowledge that these Terms are between you and Outfits AI, not Apple
• Apple is not responsible for the Service or any claims relating to it
• Apple has no obligation to provide support or maintenance for the Service
• You must comply with Apple's App Store Review Guidelines
• Apple is a third-party beneficiary of these Terms regarding your use of the app

11. Service Availability and Modifications

We strive to provide reliable service, but:

• The Service may occasionally be unavailable due to maintenance, updates, or technical issues
• We may modify, update, or discontinue features at any time
• We may impose usage limits to ensure fair access for all users
• We are not liable for any service interruptions or modifications

12. Termination

Either party may terminate this agreement:

12.1 Your Rights

• You may stop using the Service at any time
• You may delete the app from your device
• You may cancel your subscription through iOS Settings

12.2 Our Rights

• We may terminate your access for violation of these Terms
• We may suspend accounts for security or abuse concerns
• We may discontinue the Service with reasonable notice

Upon termination, your right to use the Service will cease immediately. Provisions concerning intellectual property, disclaimers, indemnification, and limitations of liability will survive termination.

13. Disclaimer of Warranties

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free
• Analysis results will be accurate, reliable, complete, or current
• Any defects in the Service will be corrected
• The Service will meet your specific requirements
• Any data or content will be secure or not lost

14. Limitation of Liability

This includes damages for:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Reliance on analysis results
• Purchasing decisions based on price estimates
• Any other commercial damages or losses

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is less.

15. Indemnification

You agree to defend, indemnify, and hold harmless Outfits AI and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Your User Content
• Your violation of any third-party rights
• Any false or misleading information you provide

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

• Posting updated Terms in the app
• Updating the "Last Updated" date
• Providing in-app notifications for material changes
• Sending email notifications if we have your email address

Your continued use of the Service after changes constitutes acceptance of the new Terms.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in California.

18. Dispute Resolution

We prefer to resolve disputes amicably:

• Contact us first to try to resolve any issues
• We will attempt good-faith negotiations
• For California residents: disputes may be resolved through arbitration
• You may have the right to opt out of arbitration in certain jurisdictions

19. Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

No waiver by us of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Outfits AI regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
